What is mediation?

Mediation is a form of Alternative Dispute Resolution (ADR) designed to settle a dispute through negotiation between the parties, facilitated by an independent, neutral 3rd party (a mediator)

How can it help me?

Bringing people together in a controlled and safe environment, each party can explore their wants and needs with the encouragement of the mediator. The process allows the parties to find imaginative solutions together. Mediation is a flexible, voluntary process and is conducted confidentially and in private. Our mediators will actively assist the parties in working towards a negotiated settlement. However, the parties are ultimately in control of the decision to settle and the terms of resolution.

The mediation process

Mediation is a voluntary process and all parties must agree to attend a mediation.

A mediator is jointly appointed and a date set for the mediation (in person or remotely).

The venue will usually have 3 separate rooms available to enable the parties to have a private room where they can relax and gather their thoughts and another room (the mediator’s room) where the parties can both attend to negotiate a settlement to the dispute.

Before the day of the mediation, each party will submit a case summary outlining their positions and highlighting the key issues in relation to the dispute.

A mediation agreement will be prepared by agreed mediation and all parties (including your mediator) will sign the agreement which records the rules and procedures that will apply during the mediation process.

At the mediation, each party will attend a joint meeting (all parties) to share their case summary and set out their positions in relation to the dispute. The mediator will then invite each party to retire to their private room and the mediator will attend each of the parties private rooms to discuss and explore their desired outcomes and help facilitate a resolution.

Once a settlement has been achieved, it will be recorded formally in to a written, legally binding agreement at the mediation and all parties must sign the settlement agreement to record the resolution that has been reached by the parties.

How much does it cost?
